Term of use below must be read before using this site. The usage of this site indicates acceptance of the term and condition below. These Terms of Use constitute a legal agreement between you and The Bali Trip Mate as a Trademark of PT. Bali Mitra Hutama Wisata and apply to your visit to and use any related products or services in our website at www.thebalitripmate.com

www.thebalitripmate.com site (“Website”) is managed by The Bali Trip Mate or PT. Bali Mitra Hutama Wisata (“we”, “us” or “The Bali Trip Mate”) as “The Operator” is a company established under the laws of the Republic of Indonesia.

By accessing and/or use of the Site, you acknowledge that you have read and understood, and agree to the Terms of Use set out below and other terms and conditions in relation to the Site, if you use any of our other services, then your usage is based on the submission to and acceptance of the terms and conditions applicable to such services.

Please note that we may change, modify, add, and delete these Terms at any time without prior notice. Every time you use the Site, please check these Terms to ensure that you have reviewed the current version.

1. DEPOSIT & FINAL PAYMENT

For all forms of reservations, a non-refundable 20% deposit from the total price as applicable, per person per Tour is due to The Bali Trip Mate. If the booking is made 30 day(s) or less prior to departure, full payment is due at the time of booking. You must make payment within the specified time limit. If the payment is not made, then The Bali Trip Mate reserves the right to cancel all reservations without prior notice.

In the event that full payment is not received by the applicable due date, The Bali Trip Mate reserves the right, at its sole discretion, to either change the rate payable for the booking or treat the booking as cancelled. In the latter case, the deposit paid on booking will be retained by The Bali Trip Mate as a cancellation fee.

For certain products or services offered by The Bali Trip Mate may require you to make full payment at the time of booking. The Bali Trip Mate will advise you of any such requirements prior to confirmation of the applicable booking

For payment by bank transfer, you must provide the bank transfer receipt as proof of payment, the bank fees shall be charged to the customer.

For payment in foreign currency, conversion into foreign currency is given as an indication and is not binding, only the currency confirmed during your reservation is guaranteed if payment is made in a currency other than that of the customer ‘s country of residence, the conversion fees shall be charged to the customer.

If you cancel your multi-day group or private tours booking, and that cancellation is not a result of nonpayment or any other breach of these Terms, the deposit amount will be held as a “Future Deposit” with The Bali Trip Mate, subject to these Terms. The Future Deposits may be applied towards payment of a deposit on any other Tour offered by The Bali Trip Mate. The Future Deposit is transferable and may be transferred by you to another individual of your choosing by providing notice to The Bali Trip Mate in writing.

For the avoidance of doubt, only the deposit amount will form part of the Future Deposit. The Future Deposit has no cash value. Only one Future Deposit may be applied per person per product booked. A Future Deposit must be applied to a new Tour booking that is of equal or greater value to the cancelled Tour for which the Future Deposit was originally received, or to a Day Tour, provided that if the price of the Day Tour is less than the amount of the Future Deposit the unused amount of the Future Deposit shall be forfeited.

2. CANCELLATION

a) Cancellation Terms for Multi-Day Tours: 

If you need to cancel your Multi-Day tours, our cancellation policy is as follows:

A cancellation which is at least 50 day(s) in advance of the scheduled departure: The Bali Trip Mate will withhold or take part of the amount that has been incurred in connection with the cancellation as a Future Deposit by these Terms, the remainder of the full payments made to The Bali Trip Mate in respect of the canceled product will be refunded.

Cancellation less than 30 day(s) and before 15 day(s) of departure – No Future Deposit will apply by The Bali Trip Mate in accordance with these Terms, an amount equal to 50% of the full payments of the canceled tour will be refunded.

Cancellation less than 15 day(s) – No Future Deposit will be held by The Bali Trip Mate in accordance with these Terms, and no further refund will be payable.

Unless otherwise set out below, the following cancellation terms apply to all Tailor-Made trip, Day Tours, Transportation and Accommodations Product: Unfortunately, No Future Deposit is established with the booking of a Tailor-Made, Day Tour, Transportation and Accommodation bookings/reservations.

b) Cancellation Terms for Tailor-Made Trip: 

Please note that deposits paid for Tailor-Made trips cannot be held as a Future Deposit. However, if you have a Future Deposit on file with us, we can apply it towards the deposit required for your Tailor-Made trip. In case of cancellation resulting in the loss of deposit, the Future Deposit applied will not be refunded or reinstated.

If you need to cancel your Tailor-Made trip, our cancellation policy is as follows:

A cancellation which is at least 60 day(s) in advance of the scheduled departure – The Bali Trip   Mate will withhold or take part of the amount that has been incurred in connection with the cancellation by these Terms, the remainder of the full payments made to The Bali Trip Mate in respect of the canceled product will be refunded.

Cancellation less than 60 day(s) and before 30 day(s) of departure – The Bali Trip Mate will refund an amount equal to 50% of the full price of the cancelled Tour.

Cancellation made less than 30 day(s) original departure/arrival – no refund will be payable.

c) Cancellation Terms for Day Tours & Transportation: 

If you need to cancel your Day tours and Transportation booking our cancellation policy is as follows:

A cancellation which is at least 14 day(s) in advance of the scheduled departure The Bali Trip Mate may be able to withhold or take part of the amount paid to reimburse the costs that have been incurred in connection with the cancellation.

Cancellation less than 7 day(s) and before 3 day(s) of travel – An amount equal to 50% of the Tour price of the cancelled Tour will be refunded.

Cancellation less than 3 day(s) – No refund will be payable.

c) Cancellation Terms for Accommodation: 

All cancellation for bookings/reservations for accommodation subject to each Hotel, Resort or Villas cancellation policies. The Bali Trip Mate act as sales of the vendors is not responsible for any violation of these terms and conditions which are agreed on between the Accommodation and the User when booking placed via The Bali Trip Mate, or which are based on the user’s specific requests, so please read the Vendor terms and conditions carefully on their official website.

All cancellations should be in writing via email and received by The Bali Trip Mate at least 48 hours before original departure/arrival date.

3. TRAVEL INSURANCE

Travel insurance is highly recommended for all guests covering all applicable dates of travel with the Provider. This insurance should cover: trip interruption, personal injury, medical expenses, evacuation and repatriation cover including during pandemic events. The choice of insurer is yours. The availability of travel insurance and extent of cover, in the event that you are unable to travel with us or need to curtail your trip our cancellation charges may apply in accordance with our cancellation procedure. We will not be responsible for covering the cost of any curtailment of your holiday, missed transport arrangements, additional accommodation required, or other associated costs incurred by you. You must ensure you have travel insurance which covers these costs

4. MINIMUM NUMBERS

Some trips are based on a minimum number of persons travelling. If a trip fails to satisfy minimum numbers, the trip may be cancelled or rescheduled or The Bali Trip Mate will offer an alternative similar trip available.

5. UNUSED SERVICES

You understand that adventure travel calls for flexibility, and we are committed to accommodating reasonable modifications to our products, services, or itineraries. Please note that unforeseen circumstances or events beyond our control (such as Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events, or entry/border difficulties) may require changes to the route, schedules, accommodations, activities, amenities, or mode of transportation. While we strive to minimize disruptions, we cannot guarantee notice of such changes.

Please be aware that no reimbursements, discounts, or refunds will be provided for missed or unused services after departure, unless it is determined that the fault lies solely with The Bali Trip Mate as the Tour Operator.

 6. LIABILITY

The Bali Trip Mate and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against The Bali Trip Mate for any such loss, damage, injury, or death.

7. ACCEPTANCE OF RISK

You acknowledge that adventures travel and the products and services offered by The Bali Trip Mate may involve a significant amount of risk to your health and safety. By traveling with The Bali Trip Mate you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release The Bali Trip Mate from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by The Bali Trip Mate.

8. FORCE MAJURE

The Bali Trip Mate will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for The Bali Trip Mate failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Force Majeure any event or circumstance beyond the control of the Provider, including but not limited to: (a) an act of god (such as earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning or natural disaster); (b) industrial disputes, work ban or other labour dispute or difficulty; (c) acts of terrorism, political unrest, war or threat of war, riots or civil strife; (d) failure or delays to scheduled transportation and the closure of airports or ports; (e) pandemic, epidemic or health risk; (f) governmental and administrative actions (including closure of borders and travel warnings and restrictions).

9. BEHAVIOUR

The Bali Trip Mate is here to provide the best services possible but in doing so we will not tolerate abusive or aggressive behaviour from our guests. We will refuse to deal with and may terminate the holiday without any refund will be payable of guests who assault our staff, suppliers or fellow guests or who are abusive or aggressive to them and are generally affecting the enjoyment of others with their behavior. This includes instances where you are removed from a tour due to negligence or a breach of the Terms and Conditions.

2. What personal data we collect and why we collect it
We collect the Personal Data that you provide to us when using the Site or to proceed your reservation. This includes but is not limited to: your name, The Bali Trip Mate user identification and login credentials, address, phone number, email address, hotel name, hotel location, and/or length of stay.

3. How we protect your data
We protect Personal Data by maintaining reasonable security arrangements, including physical, technical and organizational procedures, to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks.

4. Media & Marketing
You agree that, while participating in any Tour, images, photos or videos may be taken by other participants, The Bali Trip Mate or its representatives that may contain or feature you. You consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to The Bali Trip Mate, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

5. Cookies
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

Third party services include but are not limited to: website hosting, data analysis, marketing, processing credit card transactions, and service provisions. In some cases, when you interact directly with a third party to obtain services, or when you use the Site to reserve a hotel room or obtain another product or service, we may provide your Personal Data to that hotel or other third party so that you don’t have to input information multiple times.

What rights you have over your data
If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes..
